Terms of Service

1. Acceptance of Terms
By accessing our website or engaging Skaleforge for digital marketing, web development, or growth services ("the Services"), you agree to be bound by these Terms of Service.
2. Description of Services
Skaleforge is a growth engineering and digital marketing agency providing:
- Custom Web Development & Design
- Local SEO & Search Visibility
- Brand Identity & Strategy
- Performance Marketing & Lead Generation
- Conversion Rate Optimization (CRO)
3. Client Responsibilities
- Provide necessary access, assets, and approvals in a timely manner
- Ensure that any provided materials (logos, text, images) do not infringe on third-party copyrights
- Maintain communication during the project lifecycle to avoid delays
4. Project Scope & Revisions
The specific scope of work, deliverables, and revision limits will be defined in individual Statements of Work (SOW) or project proposals. Any requests outside the agreed scope may be subject to additional fees.
5. Intellectual Property Rights
Upon full and final payment, you will own the final deliverables (e.g., website code, logo designs). Skaleforge retains the right to display the completed work in our portfolio and marketing materials unless a strict NDA is signed.
6. Payment Terms
- Payment schedules (e.g., 50% upfront, 50% on completion) are outlined in your contract
- Invoices are due upon receipt unless otherwise specified
- Late payments may result in a pause of project work or hosting services
- Deposits are non-refundable once work has commenced
7. Confidentiality
Both Skaleforge and the Client agree to keep proprietary business information, strategies, and trade secrets strictly confidential during and after the engagement.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCALEFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Termination
Either party may terminate a project with written notice. In the event of early termination by the client, Skaleforge will be compensated for all work completed up to the date of termination.
10. Governing Law
These Terms shall be governed by the laws of India. Any disputes arising from these Terms or our Services shall be resolved in the applicable courts of India.
